These Terms of Service ("Terms") govern your access to and use of the Path website and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. Please read them carefully before using the Service.

1. About Path

Path is an apartment locating service that helps renters discover apartment listings and request tours, information, and other services. As part of its service, Path may provide eligible users with cash back upon successful completion of a qualifying move.

Path is not a real estate agency, broker, or property manager, and does not provide legal, tax, or financial advice. Apartment availability, pricing, incentives, and other listing details are provided by third-party sources and are subject to change at any time without notice.

2. Eligibility

You must be at least 18 years of age to use the Service. By accessing or using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

3. User Accounts

Certain features of the Service may require you to create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials;
  • All activity that occurs under your account, whether or not authorized by you;
  • Notifying Path promptly at info@pathhomeservices.com if you suspect unauthorized access to your account.

Path reserves the right to suspend or terminate accounts that are used in violation of these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service for any unlawful, harmful, abusive, or fraudulent purpose;
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its underlying systems or security features;
  • Scrape, harvest, copy, or systematically extract listing content, personal data, or other information from the Service without express written permission;
  • Misrepresent your identity, affiliation, or qualifications, or submit false or misleading information;
  • Use the Service to transmit unsolicited communications or engage in any activity that could harm other users.

Violation of this section may result in immediate termination of your access to the Service.

5. Listings, Accuracy, and Third-Party Content

Some listing content and related information displayed on the Service may be sourced from third-party providers, including property managers, landlords, and listing aggregators. Path does not create or control such content and cannot guarantee its accuracy, completeness, timeliness, or availability.

You acknowledge that you use listing information at your own risk and are solely responsible for independently verifying all material details, including pricing, availability, fees, lease terms, and unit conditions, directly with the applicable property or provider before making any decision.

6. Tour Requests, Contact Requests, and Communications

When you submit a tour request, contact request, or similar inquiry through the Service, you authorize Path to transmit the information you provide to the relevant property representatives and/or service partners for the purpose of fulfilling your request.

By submitting such a request, you also consent to being contacted by Path, property representatives, or their agents via phone, email, or text message in connection with your inquiry. You may opt out of such communications at any time by contacting us at info@pathhomeservices.com.

Path does not guarantee response times or outcomes with respect to any tour or contact request.

7. Cash Back Program

7.1 How It Works

Path's cash back program allows eligible users to receive a cash payment after successfully leasing an apartment through the Service. The cash back amount, if any, will be disclosed to you during the Service flow prior to your lease signing.

7.2 Eligibility Requirements

To qualify for cash back, you must generally satisfy all of the following conditions, subject to the specific terms presented to you within the Service:

  • You must have used the Service to initiate contact with or request a tour of the applicable property;
  • You must have signed a new lease for a qualifying apartment unit;
  • You must not have previously toured or applied to that property without Path's involvement;
  • You must submit any required documentation or verification requested by Path within the specified timeframe;
  • You must comply with all applicable laws governing real estate rebates in your state or locality.

7.3 Payment

Cash back payments are issued as a mailed check to the address you provide. It is your responsibility to ensure your mailing address is accurate. Path is not liable for checks lost, delayed, or undeliverable due to an incorrect address.

Payments are typically issued within a reasonable time after lease verification is complete. Path will make reasonable efforts to keep you informed of your payment status.

7.4 Program Modifications

Path may modify, suspend, or discontinue the cash back program at any time, with or without notice, subject to honoring commitments already made to users who have received a confirmed cash back offer prior to such change. Additional terms may apply and will be presented within the Service at the relevant time.

7.5 Legal Compliance

Cash back payments are subject to applicable laws and regulations. In certain states or localities, real estate rebates may be restricted or prohibited. If you are located in a jurisdiction where cash back to renters is not permitted, you will not be eligible for the program. It is your responsibility to determine whether receipt of a cash back payment is lawful in your jurisdiction.

8. Intellectual Property

The Service and its original content, including but not limited to text, graphics, logos, software, and design elements, are owned by or licensed to Path and are protected by applicable intellectual property laws. Third-party listing content remains the property of its respective owners.

You may not reproduce, distribute, publicly display, modify, or create derivative works from any portion of the Service without Path's prior written permission. Unauthorized use may violate copyright, trademark, and other applicable laws.

9. Privacy

Your use of the Service is also governed by Path's Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. 10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PATH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

PATH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION OBTAINED THROUGH THE SERVICE WILL BE ACCURATE OR RELIABLE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PATH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL PATH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT OF CASH BACK, IF ANY, PAID TO YOU BY PATH IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such jurisdictions, Path's liability is limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Path and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with:

  • Your use of or inability to use the Service;
  • Your violation of these Terms or any applicable law or regulation;
  • Your infringement or misappropriation of any third-party rights; or
  • Any information or content you submit through the Service.

Path reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with Path's defense of such claim.

13. Changes to the Service or Terms

Path may update or modify the Service and these Terms from time to time. If we make material changes, we will provide notice by updating the "Last Updated" date at the top of these Terms and, where appropriate, by providing additional notice within the Service or by email.

Your continued use of the Service after any changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.

14. Termination

Path may suspend or terminate your access to the Service at any time, with or without cause or notice, if Path believes you have violated these Terms or for any other reason at Path's discretion. Upon termination, your right to use the Service will immediately cease.

Sections 8, 10, 11, 12, 15, and 16 shall survive any termination or expiration of these Terms.

15. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Texas, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.

Before initiating any formal legal proceeding, you agree to first contact Path in good faith at info@pathhomeservices.com and attempt to resolve any dispute informally for at least thirty (30) days.

16. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy and any additional terms presented to you within the Service, constitute the entire agreement between you and Path with respect to the Service and supersede all prior agreements, understandings, and communications.

Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Path's failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms without Path's prior written consent. Path may freely assign these Terms.

No Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights.
